Welcome to MathCrave! These Terms and Conditions ("Terms") govern your access to and use of the MathCrave application (the "App"), our website located at moogletechnology.com (the "Site"), and all related content, features, and services offered by MoogleTechnology ("MathCrave," "we," "us," or "our") (collectively, the "Services").
By downloading, accessing, browsing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available at Privacy Policy), which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use our Services.
MathCrave provides a comprehensive platform for learning and engaging with a wide range of mathematical topics. Our Services include access to structured educational modules (such as "Section A: Number and Algebra," "Section I: Differential Calculus," "Section M: Laplace Transforms," and many others as detailed within the App and on our Site), interactive features (if applicable), and other resources designed to support your mathematical understanding and skills (the "Content").
Registration: To access certain features of the Services, you may be required to register for an account. If you register, you agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Account Security: You are responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized such activities or actions. You agree to notify MathCrave immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with this security obligation.
Eligibility: You must be at least 13 years old (or the age of digital consent in your jurisdiction) to create an account and use the Services. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Subject to your compliance with these Terms, MathCrave grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services and Content solely for your personal, non-commercial, educational purposes.
Our Ownership: All rights, title, and interest in and to the Services and Content, including but not limited to the MathCrave name, logo, the design of the App and Site, text, graphics, images, videos, software, and all educational materials and modules (from "Section 1: Basic arithmetic" through "Section 106: The complex or exponential form of a Fourier series" and all other modules provided) are and will remain the exclusive property of MoogleTechnology and its licensors. The Services and Content are protected by copyright, trademark, and other laws of Canada and foreign countries.
No Other Rights: Except for the limited license granted in Section 4, nothing in these Terms grants you any right, title, or interest in or to the Services or Content. You agree not to copy, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content, except as incidentally necessary to use the Services.
Feedback: If you provide us with any feedback, suggestions, or ideas regarding the Services ("Feedback"), you hereby grant MathCrave a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Feedback for any purpose without any obligation or compensation to you.
You agree not to use the Services in any way that:
Free Services: Currently, access to certain features of MathCrave may be provided free of charge.
Subscription Services/Premium Features: MathCrave may offer certain premium features or content through a subscription model or one-time purchase ("Paid Services"). If you choose to purchase Paid Services, you agree to pay all applicable fees as described on the Site or in the App.
Payment: All fees are payable in accordance with payment terms in effect at the time the fee becomes payable. We may use a third-party payment processor to bill you through a payment account linked to your account. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor, in addition to these Terms.
Subscription Renewals and Cancellations: If you purchase a subscription, it may automatically renew unless you cancel it. You may cancel your subscription as per the instructions on our Site or App.
No Refunds: Unless otherwise specified or required by applicable law, all fees are non-refundable.
Changes to Fees: We reserve the right to change our fees or billing methods at any time. We will provide you with reasonable notice of any such changes.
The Services may contain links to third-party websites or services that are not owned or controlled by MathCrave. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that MathCrave shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. We encourage you to be aware when you leave our Services and to read the terms and conditions and privacy policies of any other website or service that you visit.
THE SERVICES AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, MathCrave DOES NOT WARRANT THAT: (A) THE SERVICES OR CONTENT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE INFORMATION OR CONTENT OBTAINED THROUGH THE SERVICES (INCLUDING ALL MATHEMATICAL MODULES AND EXPLANATIONS) WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE; OR (D) ANY ERRORS IN THE CONTENT OR SERVICES WILL BE CORRECTED.
MathCrave IS AN EDUCATIONAL TOOL. WHILE WE STRIVE FOR THE HIGHEST DEGREE OF ACCURACY IN OUR MATHEMATICAL CONTENT, WE DO NOT GUARANTEE THE ABSENCE OF ERRORS OR OMISSIONS. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICES AND RELIANCE ON ANY CONTENT IS AT YOUR SOLE RISK. MathCrave DOES NOT GUARANTEE ANY SPECIFIC LEARNING OUTCOMES, EXAM RESULTS, OR ACADEMIC SUCCESS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MathCrave, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF MathCrave HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR RELATING TO: (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES OR CONTENT; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL MathCrave'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS EXCEED THE GREATER OF (I) THE AMOUNT YOU HAVE PAID TO MathCrave FOR USE OF THE SERVICES IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (II) ONE HUNDRED CANADIAN DOLLARS ($100.00 CAD), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATIONS TO MathCrave.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless MathCrave, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, any use of the Services' Content other than as expressly authorized in these Terms.
Termination by You: You may terminate your account and stop using the Services at any time.
Termination by MathCrave: We may, in our sole discretion, suspend or terminate your access to all or part of the Services, with or without notice, for any reason, including, without limitation, if we believe you have violated or acted inconsistently with the letter or spirit of these Terms.
Effect of Termination: Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
MathCrave reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least thirty (30) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the Services. We encourage you to review these Terms periodically for any updates.
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Edmonton, Alberta, before one arbitrator. The arbitration shall be administered by the ADR Institute of Alberta or proceed with ad-hoc arbitration rules. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
Alternatively, and at MathCrave's sole discretion, any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services may be instituted exclusively in the federal or provincial courts located in Edmonton, Alberta. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Severability: If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the sole and entire agreement between you and MoogleTechnology regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
Waiver: No waiver by MathCrave of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of MathCrave to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without MathCrave's prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and void. MathCrave may freely assign or transfer these Terms without restriction.
Notices: Any notices or other communications provided by MathCrave under these Terms, including those regarding modifications to these Terms, will be given: (i) via email; or (ii) by posting to the Site or App. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.
